PF2025-23 Compliance With Federal Anti-Discrimination Laws

SUMMARY: This Policy Flash transmits new DOE Corporate Clause DOE-H-2089 Compliance With Federal Anti-Discrimination Laws.
The new Corporate Clause shall be used in all new solicitations and contract awards exceeding the Simplified Acquisition Threshold (SAT). Existing awards with a total value exceeding the SAT and remaining periods of performance or delivery time of six (6) months or more shall be modified at the earliest opportunity to incorporate the new clause. When exercising an option term, contracting officers should consider modifying the existing contract to add the clause prior to exercise of an option term, rather than at the time of option exercise, to: (1) avoid losing the Government’s unilateral right to exercise the option, and (2) provide contractors with adequate time to comply with the clause.
