DOE ordered Teco Electric and Machinery Company to pay a civil penalty of $10,136. Teco Electric had manufactured and distributed in commerce in the U.S. various units of the noncompliant Teco Electric basic model AETHPE.  The Order also adopted a Compromise Agreement, which reflected settlement terms between DOE and Teco Electric.

On April 23, 2019, DOE issued a Notice of Allowance to Teco.  Based on the test data Teco Electric provided, the new basic model, AETHPE060001YHX01, appears to comply with the applicable performance standards and is a suitable replacement for the noncompliant basic model, AETHPE.  Basic model AEEHED was not modified and therefore DOE’s determination with respect to AEEHED was not affected by the notice.

On July 31, 2018, DOE issued a Notice of Noncompliance Determination to Teco Electric finding that the Teco Electric models AETHPE and AEEHED of electric motors do not comply with applicable energy conservation standards. Further, DOE noted that these two models were used to substantiate the AEDM using nominal efficiencies that were not supported by test data.
