An ALJ determined that Chigo Electrical Appliances manufactured and distributed in commerce basic models of dehumidifiers for at least 365 days; the basic models are subject to the energy conservation standards at 10 C.F.R. § 430.32(v)(1); and before distributing the basic models in commerce, Chigo Electrical Appliances knowingly failed to submit to DOE a report certifying that each of the basic models complies with those energy conservation standards. Additionally, the ALJ determined that Chigo Electrical Appliances failed to test the basic models of dehumidifiers in accordance with the applicable test requirements in 10 C.F.R. part 430. The ALJ held that Chigo Electrical Appliances knowingly violated 10 C.F.R. § 429.102(a)(1), (2), and (6) and recommended that DOE assess Chigo Electrical Appliances, Inc. a $ 3,092,580 civil penalty.
