DOE ordered Broada, Inc. to pay a $8,000 civil penalty after finding Broada had failed to certify that certain medium base compact fluorescent lamps comply with the applicable energy conservation standards. The Order adopted a Compromise Agreement, which reflected settlement terms between DOE and Broada.
DOE alleged in a September 9, 2016 Notice of Proposed Civil Penalty that Broada had failed to certify medium base compact fluorescent lamps as compliant with the applicable energy conservation standards. DOE regulations require a manufacturer (which includes importers) to submit reports certifying that its products have been tested and meet the applicable energy conservation standards. The civil penalty notice advised the company of the potential penalties and DOE's administrative process, including the company's right to a hearing.
