DOE ordered Turbo Air, Inc. to pay a $79,480 civil penalty after DOE testing showed that Turbo Air commercial ice-cream freezer basic model TSD-27CF does not comply with the energy conservation standard for commercial ice cream freezers. Turbo Air had manufactured and distributed in commerce in the U.S. multiple units of the models. The Order adopted a Compromise Agreement, which reflected settlement terms between DOE and Turbo Air.

DOE issued a Notice of Noncompliance Determination to Turbo Air on August 7, 2015, finding that Turbo Air basic model TSD-27CF does not comport with the energy conservation standards. DOE determined the products were noncompliant based on DOE testing.  Turbo Air notified each person (or company) to whom Turbo Air distributed the noncompliant products that the products do not meet Federal standards. In addition, Turbo Air provided to DOE documents and records showing the number of units Turbo Air distributed and to whom.
