An ALJ determined that SHUWND manufactured and distributed in commerce a basic model of showerheads for at least 305 days; the basic model is subject to the energy conservation standards at 10 C.F.R. § 430.32(p); and before distributing the basic model in commerce, SHUWND knowingly failed to submit to DOE a report certifying that the basic model complies with those energy conservation standards. The ALJ held that SHUWND knowingly violated 10 C.F.R. § 429.102(a)(1) and recommended that DOE assess SHUWND a $153,415 civil penalty.
