DOE ordered Broich Enterprises, Inc. to abide by the terms of the Notice of Noncompliance Determination, issued on August 10, 2015 after DOE testing showed that commercial freezer model AUC-27F does not comply with the energy conservation standard. Broich had manufactured and distributed in commerce in the U.S. multiple units of the model. The Order adopted a Compromise Agreement, which reflected settlement terms between DOE and Broich.

DOE issued a Notice of Noncompliance Determination to Broich on August 10, 2015, finding that Broich model AUC27F does not comport with the energy conservation standards. DOE determined the products were noncompliant based on DOE testing.  Broich notified each person (or company) to whom Broich distributed the noncompliant products that the products do not meet Federal standards. In addition, Broich provided to DOE documents and records showing the number of units Broich distributed and to whom.
