DOE ordered Asbury Foodservice Equipment Company to abide by the terms of the Notice of Noncompliance Determination.

DOE ordered Asbury Foodservice Equipment Company to abide by the terms of the Notice of Noncompliance Determination dated January 28, 2016, after DOE's testing reported that Asbury commercial freezer model MXCF27U/69K-052 does not comply with the energy conservation standard for commercial freezers.  Asbury had manufactured (imported) and distributed in commerce in the U.S. multiple units of the model. The Order adopted a Compromise Agreement, which reflected settlement terms between DOE and Asbury. 

DOE issued a Notice of Noncompliance Determination to Asbury on January 28, 2016, finding that Asbury commercial freezer model MXCF27U/69K-052 does not comport with the energy conservation standards.  DOE determined the products were noncompliant based on DOE testing.   Asbury notified each person (or company) to whom Asbury distributed the noncompliant products that the products do not meet Federal standards.  In addition, Asbury provided to DOE documents and records showing the number of units Asbury distributed and to whom.
