The Energy Policy Act of 1992 (codified as 42 USC Section 8256 (c) Utility Incentive Programs) authorizes and encourages agencies to participate in generally available utility programs to increase energy efficiency; conserve water; or manage electricity demand conducted by gas, water, or electric utilities.

The turnkey utility energy service contracts (UESC) process characteristically includes a no-cost or low-cost preliminary assessment, a negotiated-cost feasibility study (or investment grade audit), a firm-fixed price proposal, financing as needed, installation, and performance assurance.
