Federal Power Act Section 202(c) Puerto Rico Electric Power Authority (PREPA)

On May 16, 2025, Department of Energy (DOE) issued two emergency orders, pursuant to section 202(c) of the Federal Power Act, to the Puerto Rico Electric Power Authority (PREPA). The first emergency order directs the PREPA to dispatch generation units necessary to expand baseload generation for the island and maintain grid reliability, closing the gap in generation shortfall. The second order directs PREPA to perform vegetation management activities –that mitigate risk of shortages and fire – to help ensure operational availability of the Specified Transmission Facilities.

On August 14, 2025, Department of Energy (DOE) issued two emergency orders extensions, pursuant to section 202(c) of the Federal Power Act, to the Puerto Rico Electric Power Authority (PREPA). The first emergency order extension directs PREPA to continue dispatching generation units necessary to maintain grid reliability and closing the gap in generation shortfall. The second order extension directs PREPA to continue performing vegetation management activities. These extension orders are in effect beginning on August 15, 2025, and continuing through November 12, 2025.
