On January 30, 2026, the Department of Energy (DOE) issued emergency DOE Order No. 202-26-09, pursuant to section 202(c) of the Federal Power Act, to Homestead Public Services (HPS) Energy (HPS/Energy). The order was issued subsequent to HPS/Energy’s application. The order authorizes HPS/Energy’s generating units located within the HPS/Energy region to operate up to their maximum generation output levels, notwithstanding air quality or other permit limitations arising under federal, state, or local law or regulation, or other applicable source of law. The order is in effect beginning on January 30, 2026, and shall expire at 10:00 a.m. EST on February 3, 2026.
