On January 24, 2026, the Department of Energy (DOE) issued emergency order no. 202-26-01, pursuant to section 202(c) of the Federal Power Act, to the Electric Reliability Council of Texas. The order was issued subsequent to ERCOT's application. The order authorizes ERCOT to direct backup generation resources at data centers and other large load customers to operate as a last resort before declaring an Energy Emergency Alert (EEA) 3 or during an EEA 3. This order is in effect immediately and will continue until 11:59 p.m. on January 27, 2026.
