PF 2026-36 Federal Acquisition Circular (FAC) 2026-01 and Associated Changes to Revolutionary FAR Overhaul Model Deviation Texts

SUMMARY: The Federal Acquisition Regulation (FAR) amendment, published in the March 13, 2026 issue of the Federal Register at 91 FR 12488. FAC 2026-01 issued one final rule – FAR Case 2025-007, Trade Agreements Thresholds.
FAR Case 2025-007 revised thresholds for application of the World Trade Organization (WTO) Government Procurement Agreement (GPA) and the Free Trade Agreements (FTA), as determined by the United States Trade Representative.
Approximately every two years, the trade agreements thresholds for the WTO GPA and the FTAs are adjusted according to predetermined formulae under the agreements. These thresholds are effective as of January 1, 2026. See the attached table for the adjusted thresholds.
In addition, the threshold changes impact several class deviations to the FAR resulting from the Revolutionary FAR Overhaul (RFO) that have been issued by DOE and NNSA. See the attached table for a list of Policy Flashes that transmitted RFO class deviations, and the associated FAR parts and sections impacted by the threshold changes. The impacted model deviation text issued via class deviations have been updated to include the revised thresholds and the Policy Flashes that transmitted the impacted model deviation texts have been updated with a note indicating that the model deviation text attached to the class deviation has been updated to implement FAR Case 2025-007, Trade Agreements Thresholds. In addition, the impacted clause has also been updated in STRIPES.
