On January 31, 2026, the Department of Energy (DOE) issued emergency DOE Order No. 202-26-12, pursuant to section 202(c) of the Federal Power Act, to Florida Municipal Power Agency (FMPA). This order was issued subsequent to FMPA’s application. This order authorizes FMPA’s generating units located within the FMPA region to operate up to their maximum generation output levels, notwithstanding air quality or other permit limitations arising under federal, state, or local law or regulation, or other applicable source of law. This order is in effect beginning on January 31, 2026, and shall expire at 10:00 a.m. EST on February 3, 2026.
