Federal Power Act Section 202(c): Duke Energy Order No. 202-26-07

On January 26, 2026, the Department of Energy (DOE) issued an emergency Order No. 202-26-07, pursuant to section 202(c) of the Federal Power Act, to Duke Energy Carolinas, LLC and Duke Energy Progress (collectively, Duke Energy). The order was issued subsequent to Duke Energy’s application. The order authorizes Duke Energy to direct backup generation resources at data centers and other large load customers to operate as a last resort before declaring an Energy Emergency Alert (EEA) 3 or during an EEA 3. This order is in effect immediately and shall expire at 11:59 p.m. EST on January 30, 2026.

On January 30, 2026, the Department of Energy (DOE) extended an emergency Order No. 202-26-07A, pursuant to section 202(c) of the Federal Power Act, to Duke Energy Carolinas, LLC and Duke Energy Progress (collectively, Duke Energy). The order was extended subsequent to Duke Energy’s application. The order authorizes Duke Energy to direct backup generation resources at data centers and other large load customers to operate as a last resort before declaring an Energy Emergency Alert (EEA) 3 or during an EEA 3. The order is in effect beginning on January 30, 2026, and shall expire at 12:00 p.m. EST on February 3, 2026.
