The Freedom of Information Act (FOIA) is a federal statute which affords any person the right to obtain federal agency records, unless the records (or a part of the records) are protected from disclosure by any of the nine exemptions contained in the law.

On October 2, 1996, President Clinton signed into law the Electronic Freedom of Information Act Amendments of 1996. "Agency records" obtainable under the FOIA include a wide range of documents or other materials (including print, photographic, and electronic formats) that were created or obtained by a Federal agency and are, at the time the request is filed, in that agency's possession and control.

The Department’s Freedom of Information Act (FOIA) Program is administered by the Office of Management. The DOE is committed to improving its FOIA performance, by favoring disclosure and transparency, engaging DOE’s leadership and staff more fully, working cooperatively with FOIA requesters, anticipating interest in records before requests are made and making requested records available promptly.

Currently, FOIA materials are available in 20 different DOE Reading Rooms. The documents have been consolidated into one searchable database and placed on the FOIA Portal. Public users are now capable of conducting subject matter requests and viewing all documents that are related to the subject matter that have been released under FOIA. This reduces the number of duplicative requests as well as providing the public with a one stop search for records of interest. The Portal also helps DOE officials understand the needs and interests of the public.
