DOE ordered A.O. Smith Water Products Company to pay a $2,193,800 civil penalty after A.O. Smith had manufactured and distributed in commerce in the U.S. multiple units of the noncompliant A.O. Smith water heater basic model # ATO 110 100.  The Order adopted a Compromise Agreement, which reflected settlement terms between DOE and A.O. Smith.

On February 26, 2018, DOE issued a Notice of Noncompliance Determination to A.O. Smith finding that the A.O. Smith water heater basic model # ATO 110 100, does not comply with applicable energy conservation standards based on DOE testing. A.O. Smith provided DOE records showing the number of units A.O. Smith distributed.
