An ALJ determined that Kale Environmental Technology (Shanghai) Corporation (“Kale Fans”) manufactured and distributed in commerce basic models of large-diameter ceiling fans for at least 365 days; the basic models are subject to the energy conservation standards at 10 C.F.R. § 430.32(s); and before distributing the basic models in commerce, Kale Fans knowingly failed to submit to DOE a report certifying that each of the basic models complies with those energy conservation standards. The ALJ held that Kale Fans knowingly violated 10 C.F.R. § 429.102(a)(1) and recommended that DOE assess Kale Fans a $1,780,470 civil penalty.
