DOE ordered Air-Con to comply with the terms of the Compromise Agreement after finding Air-Con had manufactured and distributed in commerce in the U.S. multiple units of a noncompliant basic model of split-system central air conditioning and heat pump consisting of outdoor model A13CH4HG09 and indoor model A13EM4HG09 both branded and sold as Air-Con models. The Order adopted a Compromise Agreement, which reflected settlement terms between DOE and Air-Con.
On July 28, 2017, DOE issued a Notice of Noncompliance Determination to Air-Con finding that a basic model of split-system central air conditioning and heat pump consisting of outdoor model A13CH4HG09 and indoor model A13EM4HG09 both branded and sold as Air-Con models does not comport with applicable energy conservation standards based on DOE testing. Air-Con was required to notify each person (or company) to whom Air-Con distributed the noncompliant products that the product does not meet Federal standards and provide to DOE documents and records showing the number of units Air-Con distributed and to whom.
