An ALJ determined that Advanced Insulation Concepts, Inc. manufactured and distributed in commerce basic models of doors for walk-in coolers and freezers for at least 365 days; the basic models are subject to the energy conservation standards at 10 C.F.R. § 431.306; and before distributing the basic models in commerce, Advanced Insulation Concepts, Inc. knowingly failed to submit to DOE a report certifying that each of the basic models complies with those energy conservation standards.  The ALJ held that Advanced Insulation Concepts, Inc. knowingly violated 10 C.F.R. § 429.102(a)(1) and recommended that DOE assess Advanced Insulation Concepts, Inc. a $137,696 civil penalty.
