On August 9, 2019, an Administrative Judge issued a decision in which she determined that an Individual should not be granted access authorization. In a Notification Letter issued to the Individual, the DOE alleged the existence of derogatory information under Adjudicative Guideline G, regarding the Individual's alcohol use, and Adjudicative Guideline E, regarding the Individual's lack of candor on his application for access authorization. After conducting a hearing, the Administrative Judge determined that the Individual had not established a pattern of abstinence and was not rehabilitated. The Administrative Judge relied upon that finding to conclude that the Individual had not mitigated the concerns related to his alcohol consumption. The Administrative Judge also found that the Individual had not mitigated his lack of candor. Accordingly, the Administrative Judge found that the Individual should not be granted access authorization. OHA Case No. PSH-19-0027 (Kimberly Jenkins-Chapman).
