On November 21, 2018, an Administrative Judge issued a decision in which he determined that an Individual’s access authorization should not be restored. In a Notification Letter issued to the Individual, the DOE alleged the existence of derogatory information under Adjudicative Guideline G regarding his use of alcohol and recent charge of Driving While Intoxicated. After conducting a hearing, the Administrative Judge determined, among other things, that the individual’s testimony regarding his alcohol use, including his relatively recent abstinence, was unreliable and that he had not engaged in any treatment or counseling to address the concerns presented by his alcohol use. The Administrative Judge relied upon those findings and the conclusion of the testifying DOE Psychologist to conclude that the Individual had not mitigated the security concerns related to his use of alcohol. Accordingly, the Administrative Judge concluded that the Individual’s access authorization should not be restored. OHA Case No. PSH-18-0062 (James P. Thompson III).
