SUMMARY: This class deviation updates the Department of Energy Acquisition Regulation (DEAR) Part 901 - Federal Acquisition Regulations System to implement the changes to the Federal Acquisition Regulation (FAR) Part 1 - Federal Acquisition Regulations System by the Federal Acquisition Regulatory Council through the Revolutionary FAR Overhaul (RFO) initiative and make other deregulatory revisions to DEAR Part 901 pursuant to Executive Order (E.O.) 14275, Restoring Common Sense to Federal Procurement.
The DOE class deviation, DEAR Part 901 Deviation Text – Line out, DEAR Part 901 Deviation Text – Final, and the class deviation where DOE and NNSA adopted RFO FAR Part 1 (including the following attachments to that class deviation: OMB Memorandum M-25-26, Overhauling the Federal Acquisition Regulation, FAR Council Memorandum titled Deviation Guidance to Support the Overhaul of the Federal Acquisition Regulation, are attached.
As detailed in the attached class deviation (item 7.f.), during the Revolutionary FAR Overhaul rewrite of the FAR, the DEAR will not be renumbered to align with the revised FAR, and therefore, until the FAR and DEAR are updated through formal rulemaking, DEAR parts, subparts, sections, subsections and paragraphs will not always match RFO FAR parts, subparts, sections, subsections and paragraphs. However, references to the FAR within the DEAR will be updated through class deviations to align with the RFO-revised FAR parts. In addition, a crosswalk is available to help staff match existing DEAR sections to the corresponding section in the applicable RFO FAR model deviation text. The crosswalk will be updated as new RFO FAR parts are released.
