SUMMARY: The two-year cost share pilot program extension established in Section 10725 of the Research and Development, Competition and Innovation Act of 2022 (RDCIA), P.L. 117- 167 ended on August 8, 2024. The cost share pilot program exempted institutes of higher education (IHEs) and nonprofit institutions or organizations (NPOs) from the requirement that the Secretary, or designee, require not less than 20 percent non-Federal cost share for applied research and development (R&D) activities unless a waiver is executed. 

As of August 9, 2024, the cost share class deviation provided in FAL 2023-04 (PF 2023-27) can no longer be used or applied to new awards for applied R&D activities performed by IHEs and NPOs. DOE program, contracting and grants officials must adhere to the cost sharing requirements in 2 CFR 910.130 for new, renewal and supplemental awards. Consequently, as of August 9, 2024, requests for a reduction or elimination of cost share requirements for R&D activities must be approved by the Secretary, or designee. 

If the cost-share exception was utilized in awards made during the two-year pilot program extension to IHEs and NPOs it will remain in effect until the initial award period of performance expires. Contracting and Grants Officers must appropriately revise the terms and conditions, including applicable cost share requirements, for any renewal, supplemental or other modification to such awards executed on or after August 9, 2024, that either revise the initial period of performance or increase the value of the award.
