On June 28, 2024, the Director of the Office of Hearings and Appeals determined that DOE did not act arbitrarily or capriciously in finding Appellant ineligible for hydroelectric incentive payments. Appellant submitted evidence that its capital incentive project was not authorized by FERC, which resulted in its application being incomplete. Accordingly, the Director denied the appeal.
