September 21, 2020On September 21, 2020, the Office of Hearings and Appeals (OHA) denied a Freedom of Information Act (FOIA) appeal filed by Julie Reddick (Appellant) concerning a FOIA request made to the Department of Energy's (DOE) Office of Public Information (OPI). Appellant's FOIA request sought the "complete" version of a report included in DOE's FY 2021 budget request and indicated that the budget request stated that the report was " available upon request." OPI referred the request to the Office of the Chief Financial Officer (CFO) to conduct a search. CFO identified the location of the data referenced in DOE's FY 2021 budget request, but indicated that it was not organized as a report and that CFO could not export the data without manually creating a new record. OHA determined that the search was reasonably calculated to locate responsive records, and that CFO was not required to create a new record to respond to Appellant's FOIA request. Therefore, OHA denied Appellant's appeal. OHA Case No. FIA-20-0044.
