November 26, 2019On November 26, 2019, OHA denied a Freedom of Information (FOIA) Appeal filed by Gregory Kucera from an interim determination issued by the DOE's Office of Public Information (OPI). In the Appeal, the Appellant challenged OPI's denial of the Appellant's request for expedited processing. The FOIA provides that expedited processing is to be offered only when the requester demonstrates a "compelling need" or when otherwise determined by the agency. After a review, OHA determined that OPI appropriately denied the Appellant's request for expedited processing because he did not demonstrate a compelling need as defined by the FOIA. Accordingly, OHA denied the Appeal. OHA Case No. FIA-20-0009.
