    In the Matter of Hudson-Reed Limited, DOE Case number 2010-CW-1403, Notice of Proposed Civil penalty DOE found 65 alleged violations and a maximum possible assessment of $110 per day per violation prior to Jan. 13, 2010 and $200 per day per violation beginning Jan. 13, 2010. Note: failure to submit a certification report is a seperate violation for each basic model. DOE proposed a civil penalty of $1,920,200. DOE specifically alleges that (1) Hudson-Reed Limited sells and/or distributes a variety of showerheads in commerce in the United States; (2) the showerhead models in question have been in distribution in the U.S. for at least 365 days; (3) the showerhead models are "covered products" under 42 U.S.C. section 6291 and 10 C.F.R. section 430.2; (4) Hudson-Reed Limited failed to certify that each basic model of the covered products meets the applicable water conservation standard as required by 10 C.F.R. section 430.62 ; (5) Hudson-Reed Limited failed to submit a certification report and compliance statement to DOE for each basic model of covered product as required by 10 C.F.R. section 430.62.
