May 28, 2010In the Matter of Summit Manufacturing, Inc., DOE Case Number: 2010-SE-0303, Notice of Noncompliance Determination Summit's third-party representative, the Air-Conditioning, Heating and Refrigeration Institute, submitted a certification report for a split-system air conditioning heat pump with a heat pump coil manufactured by Summit. Based on Summit's certification, made through its third-party representative, DOE determined that the 4SHP13LE136P + 15001+CA042A964+TDR basic model does not meet applicable DOE standards. In light of this finding, Summit must (1) immediately cease distribution of the basic model; (2) provide immediate written notification to all persons to whom Summit distributed the basic model; (3) provide immediate written notification to all persons to whom Summit distributed components of the basic model; (4) provide within 30 calendar days of May 28, 2010 any and all records , reports, and other documentation pertaining to the acquisition , ordering, storage, shipment, or sale of the basic model, or any component thereof. May 28, 2010In the Matter of Aspen Manufacturing (split system air conditioning, heat pumps and coils), DOE Case Number: 2010-SE-0305, Notice of Noncompliance Determination and Subpoena for Information and Production of Documents. The Air-conditioning, Heating, and Refrigeration Institute submitted a certification report on behalf of Aspen Manufacturing, and DOE found that certain of its products violated applicable energy conservation standards. After listing such violations, DOE notes required actions by Aspen, including ceasing all distribution of products, providing notice of these failures to customers, and submitting all documentation for these products within 30 days (a requirement which is elaborated in the attached subpoena, with a list of required questions to answer in the submitted documentation). DOE also lists optional actions for Aspen, such as altering products and resubmitting data, and notes what actions DOE may take should Aspen fail to act on this notice.Office of the General Counsel
