In the Matter of Air-Con International (air-conditioning systems, heat pumps), DOE Case Number 2010-SE-0301, Notice of Noncompliance Determination and Notice of Proposed Civil Penalty. DOE has admissions from Air-Con that it distributed in the US 1902+ air conditioning units that violate federal energy conservation standards in 42 U.S.C. 6302(a)(5). Notice asserts that Air-Con must cease distribution of affected models, provide notification of this failure to those to whom the models have been distributed, and provide DOE all documentation not yet provided (within 30 days). Failure to comply with this notice will result in legal action. Accordingly, the DOE proposes a civil penalty of $231,090, which Air-Con may accept (and pay within 60 days of the issuing order), or it may refer the matter to an administrative judge, or it may seek a settlement agreement with DOE.
