Attached is the updated DOE Class Deviation for FAR 52.209-5, Certifications Regarding Responsibility Matters, addressing felony convictions under Federal laws and unpaid Federal tax liabilities. This Class Deviation was previously provided in Policy Flash 2012-40. The Class Deviation has been updated to reflect additional direction to federal agencies contained in Civilian Agency Acquisition Letter 2014-01. Solicitation provisions are now included for FY 2012 and 2013 funding actions, and for FY 2014 and subsequent year funding actions. A FAR case has been initiated to formally incorporate the guidance into the FAR.
