PF 2025-29 Class deviation pursuant to CAAC Letter 2025-01 Supplement 1, CAAC Consultation to Issue a Class Deviation From the Federal Acquisition Regulation (FAR) Regarding Executive Orders 14173 and 14168

SUMMARY: The subject class deviation is issued pursuant to Civilian Agency Acquisition Council (CAAC) Letter 2025-01 Supplement 1 (which superseded the original CAAC Letter 2025-01), issued by the CAAC on February 18, 2025, which
allows agencies to authorize a class deviation pursuant to the CAAC Letter requiring contracting officers to deviate from the FAR to ensure compliance with Executive Order (E.O.) 14173, Ending Illegal Discrimination and Restoring Merit-Based Opportunity and E.O. 14168, Defending Women From Gender Ideology Extremism and Restoring
Biological Truth to the Federal Government. The DOE class deviation, CAAC Letter 2025-01 Supplement 1 with FAR Deviation Text, and Supplemental Agency Guidance are attached. Please note that the attached FAR Deviation Text was updated on February 26, 2025 without a corresponding update to the CAAC Letter; therefore, some of the changes identified in CAAC Letter Supplement 1 are not reflected in the attached FAR Deviation Text document (e.g., clause 52.222-9 Apprentices and Trainees is not deleted in its entirety, but is deviated to delete paragraph (c) only, and the deviations identified for clauses 52.222-6 Construction Wage Rate Requirements, 52.222-11 Subcontracts (Labor Standards), and 52.222-12 Contract Termination—Debarment in CAAC Letter 2025-01 Supplement 1 have been removed from the updated FAR Deviation Text). The FAR changes identified in the FAR Deviation Text document supersede the FAR changes identified in CAAC Letter 2025-01 Supplement 1 and should be used by acquisition staff when issuing new solicitations, awarding new contracts, and modifying existing contracts, pursuant to the attached Supplemental Agency Guidance.
