DOE ordered Hefei Midea Laundry Appliance Co. Ltd. ("Hefei Midea") to pay a $800,000 civil penalty after Hefei Midea had manufactured and distributed in commerce in the U.S. 1,503 units (2016-SE-20005) and 2,375 units (2016-SEW-20004) of the noncompliant clothes washer basic numbers MAE50-S1102GPS/M-13-K4 and MAE70-S1402GPS/M-13-K4. The Order adopted a Compromise Agreement, which reflected settlement terms between DOE and Hefei Midea.
Federal law subjects manufacturers and private labelers to civil penalties if those parties distribute in the U.S. products that do not meet applicable energy conservation standards. DOE issued a civil penalty notice on June 10, 2020 (2016-SE-20005) and June 11, 2020 (2016-SEW-20004), advising the company of the potential penalties and DOE's administrative process, including the company's right to a hearing.
On September 24, 2018, DOE issued a Notice of Noncompliance Determination to Hefei Midea finding that the clothes washers, which includes basic model numbers MAE50-S1102GPS/M-13-K4 and MAE70-S1402GPS/M-13-K4 does not comply with applicable energy conservation standards basic on DOE testing. Hefei Midea provided DOE records showing the number of units Hefei Midea distributed.
