On September 20, 2021, the Office of Hearings and Appeals (OHA) denied a Freedom of Information Act Appeal filed by Nancy Milburn (Appellant) of Arnold & Porter Kaye Scholer, LLP (Arnold & Porter) from a partial determination and a final determination issued by the Department of Energy's Office of Public Information (OPI). On Appeal, the Appellant alleged that DOE did not perform an adequate search for responsive records. Appellant's FOIA request sought nine categories of records, items A through I, relating to West Hackberry Strategic Petroleum Reserve. OPI referred the case to Fossil Energy (FE), and two different FE components, OPR and SPRPMO, conducted searches. OPR conducted a keyword search for annual reports consistent with a subcategory of item A on the OPR website. OPR also conducted a manual search of OPR's files including a search for pre-1982 archived and hard copy responsive documents. In OPI's partial determination letter, it provided Appellant with 19 documents, and a review by OHA found these documents to be responsive to item A. SPRPMO conducted searches for the remaining subcategories for item A, and it conducted searches for items B through I. SPRPMO's search certificates reflected that SPRMO conducted key word searches using search terms that were consistent with the suggested search terms in Appellant's Revised Request. SPRPMO's searches were done on the SPR public website, and in SPRPMO's SharePoint database where official documents, including pre-1982 archived documents are   managed.   OHA   found   that SPRPMO provided a sufficiently detailed description of its searches, including the search terms used, the locations and storage systems where it searched, and how the search was conducted. Upon review, OHA determined that the searches were reasonably calculated to uncover responsive documents. Further, OHA reviewed the nine documents provided to Appellant by OPI in its final determination, and found that the documents were responsive to Appellant's request for the remaining categories.
