On January 4, 2022, issued a Decision in the December 9, 2022, OPTI-UPS Corporation’s Application for Exception to and Stay of the applicable provisions of DOE's Energy Conservation Program: Energy Conservation Standards for Uninterruptible Power Supplies published on January   10, 2020, at 85 Fed. Reg. 1447 and codified at 10 C.F.R. 430.32(z), which have an effective date of January 10, 2022. OPTI-UPS requested an exception to the applicability of the Standards, with respect to its Model GS1100B uninterruptible power supply (UPS), for one year. In support of its application, OPTI-UPS stated that it had only learned of the new standards in November 2021. The OHA found that, under federal law, regulated parties are considered notified of regulations when their Final Rules are lawfully published in the Federal Register. Accordingly, the OHA found that OPTI-UPS had not shown that compliance with the new standards would cause special hardship, inequity, or unequal distribution of burdens.  Therefore, the Application for Exception and Stay was denied.
