This Decision and Order considers an Application for Exception filed by Vestfrost Zrt (“Vestfrost”), a manufacturer of commercial refrigeration equipment. In its Application, Vestfrost seeks relief from the Energy Conservation Standards for Commercial Refrigeration Equipment (“Commercial Refrigeration Standards” or “Final Rule”), 79 Fed. Reg. 17,726 (March 28, 2014), codified at 10 C.F.R. Part 431, Subpart C.[1] Compliance with the Commercial Refrigeration Standards is required for equipment manufactured on or after March 27, 2017. Vestfrost asserts that it will face serious financial consequences if required to comply with the Final Rule when manufacturing three commercial refrigerator models intended for export to the U.S. market. As set forth in this Decision and Order, we have concluded that Vestfrost’s Application for Exception should be denied.
