Reminder Regarding Effective Dates for Including the COVID Contract Clause in Federal Contracts

As you are aware, the Safer Federal Workforce Task Force amended the deadline for the Federal contractor vaccination requirement in E.O. 14042 to align with the deadline in the Centers for Medicare & Medicaid Services rule and the OSHA COVID-19 Vaccination and Testing Emergency Temporary Standard. Federal contractor employees covered under the requirements of the E.O. will now need to be fully vaccinated by January 18, 2022.

While there have been revisions to the deadlines for contractors’ employees’ vaccinations, there has been no change to the effective dates in E. O. 14042. This includes requirements to modify covered existing contracts at the point of option exercise or extension and to include the COVID clause in new contracts awarded on or after November 14 from solicitations issued before October 15 or new orders awarded on or after November 14 from solicitations issued before October 15 under existing indefinite-delivery contracts.
