SUMMARY: 

Division A of Pub. L. No. 116-159, entitled “Continuing Appropriations Act, 2021, and Other Extensions Act” (Continuing Appropriations Act, 2021), provides continuing fiscal year 2021 (FY2021) appropriations to federal agencies through the earlier of December 11, 2020 or the enactment of applicable appropriations legislation.It is known as a Continuing Resolution and prevents a Government shutdown that would otherwise occur if the FY2021 appropriation bills have not been enacted when FY2021 begins on October 1, 2020.

Therefore, the Acquisition Letter AL 2020-04 and Financial Assistance Letter FAL 2020-01 implementing instructions and guidance for the Further Consolidated Appropriations Act, 2020, Division C (Energy and Water Development and Related Agencies Appropriations Act, 2020), Title III and Title V, Pub. L. No. 116-94; and the Consolidated Appropriations Act, 2020, Division C, (Financial Services and General Government Appropriations Act, 2020) Title VII, Pub. L. No. 116-93, remains in effect until rescinded or superseded.

This also means that the Congressional Notifications and Quarterly Reporting to the Appropriations Committees as identified in AL 2020-05 and in FAL 2020-02 will continue and remains in effect until rescinded or superseded.

Separate guidance will be issued to discuss the extension provided in Section 140 of the Continuing Appropriations Act, 2021, to the authority provided to federal agencies in Section 3610 of Division A of the CARES Act (Public Law 116–136).
