The recent revision to 29 C.F.R. Part 1904, Recording and Reporting Occupational Injuries and Illnesses, cite statutory provisions included in Sections 8 and 24 of the Occupational Safety and Health Act (OSH Act) (29 U.S.C. §§ 657, 673), Section 553 of the Administrative Procedure Act (5 U.S.C. § 553), and Secretary of Labor’s Order No. 41–2012 (77 FR 3912 (Jan. 25, 2012)).As stated in Section 24 of the OSH Act (P.L. 91-596), as amended, codified at 29 U.S.C. § 673, "all employments whether or not subject to any other provisions of the Act" may be covered by the requirements under the Department of Labor’s (including the Occupational Safety and Health Administration’s (OSHA’s)) "program of collection, compilation, and analysis of occupational safety and health statistics" except for employments excluded from the OSH Act pursuant to § 4 of the Act (29 U.S.C. § 653).
