On July 02, 2018, the Office of Hearings and Appeals (OHA) denied the Complaint by Ms. Yolanda Parker complaint against Savannah River Nuclear Services (SRNS) under the Department of Energy's (DOE) Contractor Employee  Protection Program, 10 C.F.R. Part 708.  In her complaint, Ms. Parker alleged that she made protected disclosures regarding file retention and protected disclosures related to her whistleblower complaint. She alleged that SRNS retaliated against her for those disclosures by denying her fair consideration in internal hiring, prematurely ending a temporary assignment to an office outside her regular department, and creating a hostile work environment. Ms. Parker presented evidence sufficient to support her assertion that she made protected disclosures related to her whistleblower complaint, but did not present sufficient evidence to show that she made other protected disclosures. Similarly, she was unable to present evidence to show that SRNS acted in a retaliatory manner when it did not interview her for jobs for which she lacked the requisite qualifications and when it ended her temporary assignment in another office when the project she was working on finished. She was unable to show that any of the acts she alleged had contributed to a hostile work environment were targeted at her in a discriminatory, abusive manner.
