On February 20, 2018, an OHA Administrative Judge issued a decision in which he determined that an individual should be denied an access authorization. A background investigation revealed that the individual had a significant history of arrests and citations including an incident in June 2017 where local police escorted the individual to a detention center for public intoxication. A number of the arrests and incidents were related to excessive use of alcohol. After a personnel security interview, the individual was referred for an evaluation with a DOE consultant-Psychologist (DOE Psychologist). The DOE Psychologist opined that the individual suffered from individual met the diagnostic criteria for a diagnosis of Alcohol Use Disorder, Mild and that he had not demonstrated sufficient evidence of rehabilitation or reformation. The individual testified that he had reduced his alcohol consumption and that most of his arrests and citations originated approximately 10 years prior. The DOE Psychologist, after listening to the individual’s testimony found that the individual had still not demonstrated sufficient evidence of rehabilitation or reformation. Based upon the evidence adduced at the hearing, the Administrative Judge found that the individual had not mitigated the Criterion G and J derogatory information described in the Notification Letter. Consequently, the Administrative Judge found that the individual should not be granted a security clearance. OHA Case No. PSH-17-0086 (Richard A. Cronin, Jr.)
