On August 6, 2018, the Office of Hearings and Appeals (OHA) denied a Freedom of Information Act (FOIA) Appeal filed by Mr. Anthony Garzione (Appellant) from a final determination issued by the Department of Energy's Office of Inspector General (OIG). On Appeal, the Appellant alleged that OIG inappropriately withheld responsive records pursuant to Exemption 7(a) of FOIA because the Appellant believed that the OIG investigation to which the records related was not ongoing. After review, OHA determined that OIG properly withheld the records under Exemption 7(a) because the documents were compiled for a law enforcement purpose, a law enforcement proceeding was pending, and release of the documents could reasonably be expected to cause foreseeable harm to the pending enforcement proceeding.  OHA Case  No. FIA-18-0029.
