On February 12, 2018, an OHA Administrative Judge issued a decision in which he determined that an individual should be granted an access authorization. During a background investigation, the individual revealed that he had use marijuana intermittently during the period 1979 to 2014 and other illegal drugs from 1979 to 1984. The Local Security Office also alleged that the individual had violated the drug free workplace policy in effect at the DOE facility at which he is employed. The individual testified that he would use marijuana approximately once or twice during a year during that period and that for approximately half of the years during that period he did not use marijuana.  The individual also testified that he never violated the drug free workplace policy because he never used illegal drugs at the facility or reported to work under the influence of illegal drugs. The individual also presented testimony from witnesses attesting to his honesty and trustworthiness as well as their observations that the individual had not used illegal drugs at the workplace. The individual also presented testimony from the Deputy Director of the facility attesting to accuracy of the individual’s interpretation of the drug free workplace policy and her belief that the individual had never violated that policy. The individual also presented drug tests results from August 2016 and October 2017 indicating negative use of illegal drugs.  Based upon the evidence adduced at the hearing, the Administrative Judge found that the individual had mitigated the Criterion E and H derogatory information described in the Notification Letter.
