On August 13, 2020, the Office of Hearings and Appeals (OHA) denied a Freedom of Information Act (FOIA) Appeal filed by the CATO Institute (Appellant) from a determination issued by the National Nuclear Security Administration denying expedited processing. On Appeal, the Appellant alleged that the NNSA had not explained how the original request had failed to demonstrate compelling need. After review, OHA determined that the Appellant had not shown that it would suffer harm to a recognizable interest if its request was processed normally. Accordingly, OHA denied the Appeal.
