Personnel Security; Access Authorization Not Granted; Guideline F (Financial Considerations)

On  April 9, 2020, an OHA Administrative Judge issued a decision in which she determined that an Individual's DOE access authorization should not be granted. The Individual had fallen behind on mortgage payments but was unable to sell the home because of a bank policy requiring her ex-husband's signature. Her ex-husband could not be found. The mortgage was marked as a foreclosure on the Individual's credit report, but for over seven years no foreclosure proceedings were started. At the hearing, the Individual presented evidence that she had retained an attorney to handle the short sale and foreclosure defense of the home. After carefully considering the totality of the record, the Administrative Judge found that, though the Individual had made progress toward resolving the LSO's financial concerns, she had not fully resolved the concerns raised under Guideline F. Accordingly, the Administrative Judge found that the individual's access authorization should not be restored.  OHA Case No. PSH-20-0029 (Kimberly Jenkins-Chapman).
