SUBJECT: Relief Efforts for Hurricanes Harvey and Irma
SUMMARY: The Department of Energy (DOE) Senior Procurement Executive has increased the micro-purchase and simplified acquisition thresholds for Hurricane Harvey and Hurricane Irma relief efforts.
Hurricane Harvey and Hurricane Irma have both been declared major disasters by the President (see DR-4332 and DR-4335, DR-4336 and DR-4337 on the FEMA Disaster Declarations webpage), and therefore, meet the legal definition of “emergency” in accordance with DOE’s FAR Class Deviation – Exercise of Special Emergency Procurement Authorities issued on September 14, 2017 (see Policy Flash 2017-37). As a result, the emergency acquisition flexibilities listed in FAR Subpart 18.2 are available for use (along with the existing acquisition flexibilities listed in FAR Subpart 18.1).
Accordingly, the DOE Senior Procurement Executive has determined that for direct purposes of the response:
- The micropurchase threshold is increased to $20,000 for any contract to be awarded and performed, or purchase to be made in support of the designated areas. The Davis-Bacon and Service Contract Act thresholds are not changed.
- The simplified acquisition threshold (SAT) is increased to $750,000 or $13,000,000 for commercial items, for any contract to be awarded and performed, or purchased in support of the designated areas.
As the geographic areas of the Presidential declarations are revised, the geographic areas applicable to the threshold increases in this flash are simultaneously revised without further notice. These threshold increases will remain in effect as long as the associated major disaster/emergency declarations are in effect.
