SUBJECT:     Hurricane Harvey National Interest Exemption

SUMMARY:   On August 31, 2017, the U.S. Department of Labor’s Office of
                       Federal Contract Compliance Programs (OFCCP) issued a temporary exemption
                       from certain federal contracting requirements.
                      
                       For a period of three months, subject to possible extension, new Federal contracts
                       to provide Hurricane-Harvey relief efforts should contain a provision exempting
                       the contractor from having to develop written affirmation action programs as
                       required by Executive Order 11246; The Vietnam Era Veterans’ Readjustment
                       Assistance Act; and Section 503 of the Rehabilitation Act of 1973, as amended.


                       The memorandum implementing the relief is attached to this policy flash and is
                       also posted on OFCCP’s homepage at https://www.dol.gov/ofccp/. The
                       memorandum contains modifications to the equal opportunity clauses in FAR
                       sections that Federal contracting agencies may utilize in contracts entered into
                       specifically to provide Hurricane Harvey relief.
