DOE ordered Zurn Industries, LLC to pay a $22,300 civil penalty after Zurn self-reported that Zurn water closet basic model containing individual models Z5540-* and Z5530-* do not comply with the water conservation standard. Zurn had manufactured and distributed in commerce in the U.S. multiple units of the models. The Order adopted a Compromise Agreement, which reflected settlement terms between DOE and Zurn.

DOE issued a Notice of Noncompliance Determination to Zurn on January 19, 2017, finding that Zurn water close basic model containing individual models Z5540-* and Z5530-* do not comport with the water conservation standards. DOE determined the products were noncompliant based on information provided by the company. Zurn notified each person (or company) to whom Zurn distributed the noncompliant products that the products do not meet Federal standards. In addition, Zurn provided to DOE documents and records showing the number of units Zurn distributed and to whom.
