DOE ordered Victory Refrigeration to pay a $10,600 civil penalty after finding Victory had manufactured and distributed in commerce in the U.S. multiple units of commercial freezer basic model UF-48-SBS, which does not meet the applicable energy conservation standard. The Order adopted a Compromise Agreement, which reflected settlement terms between DOE and Victory.

DOE issued a Notice of Noncompliance Determination to Victory on July 26, 2016, finding that Victory commercial freezer basic model UF-48-SBS does not comport with the energy conservation standards. DOE determined the products were noncompliant based on DOE testing. Victory notified each person (or company) to whom Victory distributed the noncompliant products that the products do not meet Federal standards. In addition, Victory provided to DOE documents and records showing the number of units Victory distributed and to whom.
