DOE ordered The Legacy Companies to pay a $16,000 civil penalty after finding Legacy had failed to certify that certain basic models of commercial refrigeration equipment comply with the applicable energy conservation standard[s]. The Order adopted a Compromise Agreement, which reflected settlement terms between DOE and Legacy.
DOE alleged in a August 9, 2017 Notice of Proposed Civil Penalty that Legacy failed to certify certain basic models of commercial refrigeration equipment as compliant with the applicable energy conservation standards. DOE regulations require a manufacturer (which includes importers) to submit reports certifying that each basic model of its products subject to energy conservation standards have been tested and meet the applicable standards. This civil penalty notice advises the company of the potential penalties and DOE's administrative process, including the company's right to a hearing.
